Wisconsin Warns Election Bets Can Disqualify Voters

Wisconsin's election officials have warned residents that placing a bet on an election and then voting in it could cost them their ballot. In a notice on Tuesday titled "Don't Bet on Your Ballot," the Wisconsin Elections Commission said voters cannot legally wager on a race and cast a vote in that same race, as prediction markets like Kalshi and Polymarket pull in more political money.

"We want voters to understand that they cannot legally make a bet on an election and cast a ballot in that same election," said WEC Administrator Meagan Wolfe in a statement.

A voter who does both could face an administrative challenge to their qualifications, lose the ballot if that challenge succeeds, and be referred to the local district attorney for possible criminal charges.

Wisconsin is one of 23 states that bar betting on elections. The commission admitted it cannot police the platforms themselves, so the legal risk falls on the individual voter.

Can Regulators Actually Stop This?

Not directly. The WEC has no power over Kalshi or Polymarket, both of which let users trade on outcomes while voting in the same contests.

The warning lands as Congress weighs the STOP Corrupt Bets Act of 2026, which would ban election wagering nationwide. Until something passes, enforcement stays with the states, and Wisconsin has now put voters on notice ahead of its next election.
